THIS SERVICE IS A SOFTWARE-AS-A-SERVICE (SaaS) DATA VISUALIZATION TOOL. WE DO NOT PROVIDE FINANCIAL ADVICE, TRADING SIGNALS, OR INVESTMENT RECOMMENDATIONS. ALL DATA IS EXPERIMENTAL AND FOR RESEARCH PURPOSES ONLY.

1. Introduction and Acceptance

These Terms and Conditions ("Terms") constitute a binding legal agreement between you ("User", "you") and [VICTORIUS GOLD j.d.o.o.] ("Company", "we", "us"), governing your access to and use of the platform located at entropy.business-only.eu (the "Service").

By registering for an account, purchasing a subscription, or accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

2. Description of Service (SaaS)

The Service is a market analytics dashboard that aggregates, processes, and visualizes raw mathematical data. The Service is strictly a technological tool designed to assist users in conducting their own market research.

You expressly acknowledge that:

The "Entropy Index" metric displayed on the dashboard is an experimental statistical model.
The Service does not predict future market movements with certainty.
The Service is provided "as-is" for informational and educational purposes only.

3. Data Sources and Intellectual Property

3.1 External Data Origin

The core mathematical data, entropy calculations, and underlying raw metrics visualized on this Service are sourced from third-party open/experimental repositories, specifically entropyindex.org.

Disclaimer of Ownership: The Company does not own the source code, algorithmic logic, or the intellectual property related to the generation of the raw Entropy Index data. We act solely as a data processor and visualization provider, creating a user-friendly interface (dashboard) for this external data.

3.2 Company Intellectual Property

While the raw data is third-party, the Service's interface, design, dashboard code (HTML/CSS/JS), API caching architecture, and branding ("Entropy Terminal") are the exclusive intellectual property of the Company. You may not copy, reverse engineer, or resell access to our dashboard.

4. No Financial Advice

THE SERVICE IS NOT A FINANCIAL ADVISOR, BROKER, OR DEALER.

Content on the Service is for illustration only. It should not be construed as a recommendation to buy or sell any security or financial instrument (e.g., XAU/USD). Trading financial markets involves a substantial risk of loss.

You agree that you are solely responsible for your own trading decisions. The Company assumes no liability for any financial losses you may incur while using the Service.

5. Subscription, Payments, and Refunds

5.1 Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

5.2 Instant Access & Refund Policy

The Service provides immediate access to digital content (real-time data feeds and software). Therefore:

14-Day Refund for All Users: All customers, regardless of location, are entitled to a 14-day refund period from the date of purchase.
Conditions: Refunds are granted within 14 days as long as the request is made within the period. After 14 days, subscriptions are non-refundable except where required by law or in cases of verified technical failure.

You may cancel your subscription at any time via your account settings or the link provided in your purchase email. Access will continue until the end of the current billing cycle.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
The Company's total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount paid by you to the Company in the twelve (12) months preceding the claim.
We do not guarantee that the Service will be uninterrupted, secure, or free from errors (including data latency or API outages from the data source).

7. Indemnification

You agree to indemnify and hold harmless the Company, its affiliates, and suppliers from any claims, losses, liability, damages, and/or costs (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.

8. Governing Law and Dispute Resolution

8.1 For Customers in the European Union

These Terms are governed by the laws of [EU, CROATIA]. You agree to submit to the exclusive jurisdiction of the courts located in [CROATIA, EU] for the resolution of any disputes.

8.2 For Customers in the United States and Rest of World

You agree that any dispute arising out of or relating to these Terms shall be resolved by binding arbitration on an individual basis. Class Action Waiver: You waive the right to participate in a class action lawsuit or class-wide arbitration.

We reserve the right to modify these Terms at any time. Significant changes will be communicated via the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
